Nation’s Biggest Asbestos Tortfeasor Launches Smear Campaign
Earlier this month, as discussed on this blog, a Mississippi jury awarded an asbestos victim with a $322 million award against Chevron Phillips Chemical Co. and Union Carbide Corp., the largest award in the history of U.S. asbestos litigation.
Unwilling to go quietly, Union Carbide Corp. has now launched a smear campaign against Smith County Circuit Judge Eddie Bowen, the presiding judge in the case. In a recent motion to the appellate court, Union Carbide attorneys claimed that Judge Bowen should have recused himself from the case because his father, Howard Bowen, filed an asbestos lawsuit against Union Carbide twenty years ago.
Union Carbide Corp.’s allegations are unfortunate. Reports indicate that Judge Bowen treated the parties fairly and protected the jury from biased facts and incorrect law. Union Carbide’s attempt to sully the judge’s reputation and delay compensating an asbestos victim for his personal injury is simply out-of-bounds.
