Texas Supreme Court Holds Tort Reform Law Unconstitutional!

On Friday, the Texas Supreme Court found a 2003 tort reform law unconstitutional, saying that the law's attempt to retroactively protect a company from asbestos liability interfered with justice by an inappropriate "weighing of interests." The judiciary-not the executive or legislature-is the branch of government responsible for adjudicating disputes like those of companies such as Crown Cork & Seal, Inc. and victims like John and Barbara Robinson.

John and Barbara's story is normal in the world of asbestos exposure. As a sailor in the U.S. Navy, John was exposed to dangerous and, ultimately, lethal levels of asbestos contained in the ship's insulation. As a turns out, that insulation-and the asbestos within in-were built by an asbestos producer, Mundet, which was subsequently purchased by Crown Cork.

Friday's court ruling is a victory for victims across the state of Texas.
